Terms of Service

Agreement

These Terms of Service ("Terms") govern your use of Captunes ("Captunes", "we", "us"), the web app at captunes.app for creating lyric videos. By creating an account or using Captunes, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Captunes.

Who can use Captunes

You must be at least 13 years old, and old enough to agree to these Terms where you live, to use Captunes. If you use Captunes on behalf of an organization, you confirm that you are allowed to accept these Terms for it.

Your account

You are responsible for keeping your login details secure and for everything that happens under your account. Tell us right away at [email protected] if you think someone else has accessed it.

Your content

You keep ownership of the songs, lyrics and other material you upload and the videos you create ("Your Content"). You give us a limited, worldwide, non-exclusive license to store, process, render and transmit Your Content only as needed to provide Captunes to you, including posting it to the social accounts you connect when you ask us to. This license ends when you delete Your Content or your account, except for copies already posted to other platforms at your request.

You are responsible for Your Content. By uploading or posting it, you confirm that you own it or have all the rights, licenses and permissions needed to use it this way, including rights to the music, recordings and lyrics, and that it does not infringe anyone else's rights.

Acceptable use

You agree not to use Captunes to:

• Upload or publish music, lyrics or other content you do not have the rights to use.
• Create or post content that is illegal, hateful, harassing, sexually explicit, violent, misleading or that violates the rules of the platform you post to.
• Post spam, or post on behalf of accounts you do not own or are not authorized to manage.
• Attempt to access other users' accounts or data, or interfere with or overload the service.
• Copy, resell or reverse-engineer Captunes, or access it through automated means other than features we provide.

Posting to TikTok and other platforms

Captunes lets you connect your TikTok account and post or schedule your videos to it. When you do:

• You authorize Captunes to upload the specific videos you choose, with the caption, privacy setting and interaction settings you select, at the time you choose. We will never post without your confirmation.
• You agree to follow TikTok's Terms of Service, Community Guidelines and Music Usage Confirmation, and to disclose branded or promotional content as TikTok requires.
• TikTok, not Captunes, decides whether and how your video is published, shown, muted or removed. We are not responsible for actions TikTok takes on your content or account.
• You can disconnect TikTok at any time in Captunes or in TikTok's app settings, which cancels any scheduled posts for that account.

The same applies to any other platform you connect or export videos to.

Plans and payments

Some features may require a paid plan. If you buy one, prices and billing terms will be shown before you pay, subscriptions renew automatically until you cancel, and you can cancel at any time to stop future charges. Except where required by law, payments are non-refundable. We may change plan prices or features with advance notice.

Copyright complaints

We respect intellectual property rights. If you believe content on Captunes infringes your copyright, email [email protected] with a description of the work, where the infringing material is, your contact details, and a statement that you have a good-faith belief the use is unauthorized. We will remove infringing content and close the accounts of repeat infringers.

Our service

Captunes, including its software, design, styles and branding, belongs to us. We may add, change or remove features, and we may suspend or end your access if you break these Terms or if needed to protect the service or other users. You can stop using Captunes and delete your account at any time.

Disclaimers

Captunes is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free, that lyrics found through third-party sources are accurate, or that your videos will be accepted, published or perform well on any platform.

Limitation of liability

To the fullest extent allowed by law, Captunes will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or followers. Our total liability for any claim relating to Captunes is limited to the greater of the amount you paid us in the 12 months before the claim or US$50.

Indemnity

You agree to defend and compensate Captunes for claims, losses and costs arising from Your Content or your breach of these Terms, including claims that Your Content infringes someone else's rights.

Changes to these Terms

We may update these Terms from time to time. If we make significant changes, we will tell you by email or in the app before they take effect. Continuing to use Captunes after that means you accept the new Terms.
